“Man has more value than society or the state” wrote Mykola Berdyaev, a Ukrainian-born philosopher who has been convicted four times and nominated for the Nobel Prize seven times.
One of the directions of the strategic course of development of state policy in the process of execution of criminal punishments in accordance with international standards is the change of legislation on the rights of prisoners, in particular the receipt of free legal aid. Convicts often end up in penitentiaries with numerous legal problems. The burden of such problems leads to the deterioration of the emotional state of convicts while serving their sentences, violation of the order of serving sentences. All this after release becomes another factor influencing the re-socialization of convicts and recidivism.
In addition, the protection of the rights of young people, including children, in conflict with the law, can be harmonized with EU law through the wider implementation of restorative justice principles to maximize the removal of juvenile offenders from criminal proceedings and prevent their recidivism.
