Epidemiological situations in the world and in Ukraine in particular, forces society to take tough measures to organize the lives of the population. We have all seen that with the announcement of quarantine, people did not take such measures seriously, and began to violate sanitary rules en masse by going on picnics, walking around companies, creating crowds, not using personal protective equipment, and so on.
In view of this, the authorities have introduced liability for violating quarantine measures
Thus, in particular, administrative and criminal liability was significantly increased.
According to Article 44-3 of the Code of Administrative Offenses, liability for violation of rules on quarantine of people, sanitary and hygienic, sanitary and anti-epidemic rules and regulations, decisions of local governments on combating infectious diseases.
Quarantine rules
What do these rules include? Thus, for clarification we turn to the Law of Ukraine “On Ensuring Sanitary and Epidemic Welfare of the Population”, where sanitary and hygienic, sanitary and anti-epidemic rules and regulations should be understood as mandatory medical safety requirements for the environment and certain factors, non-compliance with which poses a threat to human health and life and future generations, as well as the threat of the emergence and spread of infectious diseases and mass non-communicable diseases among the population.
Citizens during such sanitary and anti-epidemic measures must:
- Take care of your health and the health and hygienic upbringing of your children, do not harm the health of other citizens, for example, do not go without masks to stores, thereby exposing others to danger, do not let children on playgrounds, etc. .
- Participate in sanitary and anti-epidemic measures, that is, if you have symptoms of the disease, see a doctor for a medical examination, try to isolate yourself so as not to harm other people around you.
- Undertake mandatory medical examinations and vaccinations in cases provided by law. If you test positive for the virus, follow your doctor’s instructions and do whatever it takes to recover as quickly as possible.
- Follow the orders and instructions of officials, ie, for example, the Irpin City Council has banned markets and fairs, visiting playgrounds, visiting parks and embankments, etc. If you are a resident of Irpen – you must follow these rules!
What is the amount of the fine?
Failure to comply with the above obligations provides for administrative liability in the form of penalties: for citizens – from 17 thousand UAH to 34 thousand UAH, and for officials – from 34 thousand UAH to 170 thousand UAH.
When does criminal liability occur?
If the violation of sanitary and epidemiological norms has led or could lead to the spread of an infectious disease, then there is already criminal liability. Yes, in accordance with Art. 325 of the Criminal code of Ukraine the violator faces the penalty from 17 thousand UAH to 51 thousand UAH or arrest till 6 months, or restriction of liberty for a period of up to 3 years, or imprisonment till 3 years. But, in the case when such an illegal act led to the death of people or other serious consequences – imprisonment from 5 to 8 years.
