The law on thieves in law: the bar has prepared its comments

The law on thieves in law can become an instrument of illegal criminal prosecution of citizens of Ukraine: NAAU has prepared proposals and comments on the bill.

The National Bar Association of Ukraine (NAAU) has prepared its proposals and comments on the draft law on thieves in law. This is the draft Law of Ukraine “On Amendments to the Criminal Code of Ukraine on Liability for Crimes Committed by the Criminal Community” №2513, which on January 15 considered before the second readingParliamentary Committee on Law Enforcement.

Namely, NAAU points to the following.

1. Following the legislative example of the aggressor country.

Of greatest concern is the fact that on April 1, 2019, amendments to the Criminal Code of the Russian Federation were adopted, which provided for responsibility for participation in the “criminal world”, namely for the creation and participation in the “criminal community”.

The proposed amendments to Article 28 of the Criminal Code of Ukraine provide for the commission of a crime criminal community.

Also in the Criminal code of the Russian Federation changes in Art. 35, which corresponds to Article 28 of the Criminal Code of Ukraine and introduces the concept of criminal community (“criminal community”).

A similar situation has developed with the proposed amendments to Articles 29 and 30 of the Criminal Code of Ukraine.
