Timely and proper medical care is undoubtedly one of the most important services and responsibilities of the state to citizens. Currently, the population of Ukraine is provided with medical care through a network of outpatient, inpatient and specialized institutions that should provide and guarantee a high level of medicine.
According to the Constitution of Ukraine, “everyone has the right to health care, medical assistance and health insurance”, and according to the European Charter of Patients’ Rights, “everyone has the right to access quality health care based on specifications and in strict accordance with standards.”
Thus, at the legislative level, a citizen of Ukraine seems to be well protected, but realistically assessing the results of services, there are often cases of negligence of doctors in their work, which leads to exacerbation of diseases and sometimes fatalities.
How to protect and restore your right, and bring the perpetrators to justice?
We offer you the following algorithm of actions:
- first, if you find a violation of your rights to medical care, for example, you were denied or the services were not provided properly, you can file a complaint to the chief physician of the medical institution where the violation occurred. Please note that it is advisable to file a complaint in writing, because if there is no proper response from management to your signal, you will be able to use such a statement in the future as proof of inaction of the chief physician.
- Secondly, if you do not achieve the desired result, contact the higher authorities, in particular, the Department of Health in your city, region.
- Third, you can report the negligence and inaction of medical staff of the Ministry of Health Hospital by contacting the hotline (contacts for the application can be found at:https://moz.gov.ua/garjachi-linii).
It is worth noting that the administrative way to solve problems is not the only one. Similarly, you can restore the lawsuit by going to court. This method is more effective, but to achieve the desired it is necessary to file a high-quality statement of claim, which is not an easy task.
